An assurance agreement is a type of legal contract that is made between two parties; one of whom is the Trustee while the other is the Beneficiary of the trust. An assurance agreement contains assurances towards transfer of the title, and improvements made to the property in question.

Terms and Conditions:

  • The Trustee should not transfer the title to or enter into a contract for the sale of the property in question or lease it without obtaining any prior written approval from the proper authorities in the said County, except as authorized in this Assurance Agreement.
  • The Trustee can sell the whole or any part of the property in a single transaction to any of the successor or a single successor of the beneficiary’s interests, only if such a successor, has entered into an agreement appropriate to the County and at the same time assures the completion of the improvements outlined in this Assurance Agreement, and the County has approved the transfer in writing.
  • The Beneficiary has the power to substitute assurances at any point in time during the term of this Assurance Agreement but it should be in accordance to the mentioned provisions of the said County Subdivision Regulations. The Assurance should be mentioned in the requisite form and the amount for the same should be acceptable to the said County.

This Assurance Agreement shall be active when the parties “Trustee” and “Beneficiary” set their seals as on the date 11/11/2011 (MM/DD/YY).
